What Services Do We Provide?
At Legacy Protect Wills & Estate Planning, we specialise in Will Writing and Estate Planning services in Essex. We wanted to create a holistic approach to Estate Planning. You will find all the services you will require in one place - from initial consultation right through to storage, we have you covered.
1. Will Drafting
Will drafting is the process of creating a legal document that outlines how a person's assets and property will be distributed after their death. It is a crucial step in estate planning and ensures that a person's final wishes are carried out according to what they wanted. A Will typically includes details such as who will inherit the assets, how they will be divided, and who will be responsible for managing and distributing them. It also allows individuals to appoint guardians for any minor children and make any specific requests for funeral arrangements, organ donation and gift specific items or cash gifts.
2. Trusts Written into Will
Trusts can be placed into the Will in relation to, for example, the family home; a vulnerable person; a business; assets for children and so forth. These take effect upon death of the Testator (the person who has a Will) and are managed by Trustees. As we go through the instruction meeting and listen to your needs and requirements, we can advise on what would be the most relevant to your circumstances and what you are looking to achieve.
3. Estate Planning
Estate planning refers to the process of preparing for the management and distribution of an individual's assets and properties after their death. It involves creating a comprehensive plan that outlines how one's assets will be distributed, who will manage them, and who will be the beneficiaries. This process not only ensures that an individual's wishes are carried out, but it also helps to minimise IHT (inheritance tax) and other expenses, and can provide financial security for loved ones. Estate planning can also include decisions regarding end-of-life care.
4. Lasting Power of Attorneys (LPAs)
LPA's allow for your voice to be heard in the event you lose mental or physical capacity due to injury or illness, to make decisions for yourself. There are different types of LPAs - Health & Welfare; Property & Finance; and Business Property & Finance. A health LPA will allow your appointed Attorneys to decide on things like for example, how you are cared for, and the food you are given. A finance LPA would allow your appointed Attorney access to your personal finances. A business LPA would cover any aspect of your business and it's finances ie accessing business bank accounts to pay wages. These are vital as its a misconception that the doctors and/or banks will allow a spouse to automatically make decisions on your behalf.
5. Business Succession Planning
Would you want your business sold as a going concern? Would you want to appoint Business Executors who would only deal with the Business and the decisions you have made in your Will. Would you like a family member to take over the running of your business? Does your business qualify for 50% or 100% IHT Business Property Relief (BPR)? If you have a business, then we can help you navigate the process of dealing with it in your Will.
6. Protection Insurance
We provide a signposting service if you wish to discuss personal protection insurance. This includes Life policies, critical illness, income protection, guardian insurance that would pay a monthly amount to help raise your children, home & contents, mortgage protection and much more to give your peace of mind for the future.
7. Probate Assistance
Legacy Protect Wills & Estate Planning are proudly partnered with Laurelo Ltd, who provide probate assistance. This refers to the services provided to individuals and families who are navigating the legal process of probate. Probate is the legal process of administering a deceased person's estate, including distributing assets and paying off any debts or taxes. This process can be complex and time-consuming, often requiring the assistance of a legal professional. Probate assistance can include guidance and support with the necessary paperwork, court appearances, and managing the estate's assets.
8. Funeral Plans
We have also partnered with a local family run funeral directors, Drew & Son Funeral Directors, who provide pre paid funeral services. This really does take the stress away from your loved ones at a time when they are grieving, to ensure the smooth process for everyone concerned.
9. Will Storage
Here at Legacy Protect Wills & Estate Planning, we will advise you on the best way to ensure your new Will stays in pristine condition for when it is required. All our Wills are bound when executed (signed). We provide a storage service whereby, for a small annual fee, your Will is kept safe, secure and in pristine condition. A Will could become invalid and leave the Testator intestate (without a Will) if the Will was destroyed, damaged or defaced. We can also register the Will with The National Will Archive if you wish.
Protecting the future for your loved ones
At Legacy Protect Wills & Estate Planning, we believe that prices for our services should be clear and transparent - and provide value for money.
Our promise to you is that we will get drafts to you within 48hrs of the instruction meeting.
